USO DE LA VIVIENDA FAMILIAR EN SITUACIÓN DE CRISIS MATRIMONIAL Y COMPENSACIÓN AL CÓNYUGE PROPIETARIO

RESUMEN: Se analiza en el presente trabajo el impacto patrimonial de la atribución del uso de la vivienda familiar en situaciones de crisis matrimonial, particularmente cuando dicho inmueble es propiedad privativa del cónyuge no usuario. Se estudian las ventajas de la posible compensación patrimonial al cónyuge propietario así como el diseño eficaz de la misma y su impacto en la pensión de alimentos y eventual pensión compensatoria. ABSTRACT: This paper analyzes the patrimonial impact of the allocation of the use of the family home in marital crisis situations, particularly when the property belongs to the other spouse. The possible benefits of patrimonial compensation to the owner spouse, the effective design of it and their impact on the eventual alimony and spousal support are studied in this work.
