PRIMEROS ACERCAMIENTOS AL PROCESO DE PAZ EN LA HABANA: ¿CONVENIENTE O DESPROPORCIONADO

The following article intends to illustrate the different implications posed by the peace dialogues between the Colombian National Government  and  the  Fuerzas  Armadas  Revolucionarias  de Colombia (FARC), taking place at present in La Habana, Cuba. Given  the  national  need  to  agree  on  a  special  jurisdiction  for national peace, we will analyze -from a general point of view- the nature, dimensions, and practical relevance of Due Process in Colombia. Next, we will make an effort to contextualize the problem in the factual situation that surrounds our nation. Later, we will analyze the specific content of the agreement we are familiar with so far, for which we will refer to the nearest relevant precedent of transitional justice (Justice and Peace Act). To conclude, we will present our opinion on the matter at hand. This article is the result of an investigation carried out in the course of Administrative Law I at the Pontificia Universidad Javeriana at Bogota, Colombia, in the second semester of 2015.
