Transparency and public participation have been considered as some of the fundamental principles of international conventions on the environment, especially in the regulation of GMO’s. Institutions have seen that the implementation of the right to information and the right of public participation in the approval procedures are necessary tools for ensuring public awareness and for achieving renewed social acceptance of these products. The completion of the exercise of these rights in the complex maze of norms and regulations at EU and at national levels is manifested through various interrelated fields and through competences developed throughout the regulation. Furthermore, it is necessary to take into account the existence of general and special norms and regulations for certain products. The aim of this paper is, based on the conceptual definition of the idea of marketing of GMO’s and their regulation, to unravel and to expound systematically the terms of access to documentary information and public participation dealt with under authorization procedures. We also aim to demonstrate its implementation and enforcement in the domestic Spanish context.
