The following article explores the historicaland legislative evolution regarding thenavigation of foreign warships in the territorialsea, including the different lines of thoughtconsidered in the Conference of the UnitedNations on the Law of the Sea, so as toapproach the current regime. In this context,we examine the legal situation of the previousauthorization or notification regarding theinnocent passage of warships, taking intoconsideration the legislative spirit of theUnited Nations Convention on the Law of theSea of 1982 and without losing sight of theInternational Court of Justice contributionsin the «Corfu Channel Case» analyzing itsoutstanding contributions, so as to finallyhighlight the actual practices in this field.
