Ilicitud y Justificacion algunas notas sobre la antijuridicidad en el derecho de danos chileno

TITLE: Unlawfulness and justification: some notes on illegality in chilean tort law. RESUMEN: Este trabajo presenta un breve examen sobre la antijuridicidad en el derecho de daños con especial referencia al Derecho chileno. Se analiza su conceptuación ofreciendo una explicación de las denominadas causales de justificación que tienen lugar en esta materia, como también una mirada que bordea lo filosófico y que puede ayudar a comprender de mejor forma la configuración y descripción de una acción antijurídica. En ese sentido, abordar el tema desde enfoques que trascienden una noción tradicional puede aportar nuevas consideraciones que no han tenido tanta preocupación por la dogmática civil, especialmente respecto de la antijuridicidad material que, a la postre, permite reflexionar con mayor profundidad respecto de las acciones justificadas. ABSTRACT: This work presents a brief exam about the illegality in tort law, especially in Chilean law. It analyzes its conceptualization to offer an explanation to the so-called legal exculpations that applies in this area, as too a look that borders the philosophical study and that can help understand to better the configuration and description of the illegality act. In this regard, deal with this subject focusing on notions that transcend traditional thoughts can contribute new considerations that have not been truly considerate by the civil doctrine, especially material illegality that allows justified actions be analysed in greater depth.
