This paper aims to make a chronological analysis from the income of the project environmental assessment, all relevant milestones in administrative headquarters, administrative, judicial and before the environmental tribunal. Displays the behavior of the project to the environmental contingency judgments in relation to the time it takes toprocess, its stages, it made parallels in various locations and analyzes the possible dependence on a resource over another. This paper analyzes the role of indigenous communities in view of their participation in mandatory processes and the convenience that are included from an economic perspective slated to be the factors that the holder of the project, analyze towards achieving an efficient execution terms of time and cost to achieve the project viable. This paper will analyze cases of mining prospecting "Paguanta" and expanding "CerroColorado" and the impact jurisprudential level that brought the emergence of environmental courts. Where respect the ILO Convention 169 and the environmental impact that effectively affecting a particular indigenous community is essential. Finally, it must be aware that the focus of this paper seeks to find ways to decongest the process that means addressing the different stages that make up the way for a  project to run in the terms and deadlines required by the holder thereof, without affecting the environmental impact that could result.
