EL RECONOCIMIENTO EXTRAMATRIMONIAL DEL HIJO DE LA MUJER CASADA. ANÁLISIS Y NUEVA PERSPECTIVA.

RESUMEN El presente artículo, elaborado sobre la base de la normativa peruana, en el ámbito del derecho civil de familia, busca analizar y pretende brindar una nueva perspectiva al controvertido derecho de filiación extramatrimonial. Revisaremos y detallaremos la ley n° 28457(ley que regula el proceso de filiación judicial de paternidad extramatrimonial) , y nos enfocaremos plenamente en el artículo n° 396 del Código Civil de 1984 (filiación extramatrimonial de hijo de mujer casada) y la problemática que presenta en la actualidad el ejercicio de la acción, la carga procesal y el contraste con la posible vulneración de los derechos inherentes al menor(hijos), consagrados no solo en la Constitución Política de 1993 sino en el Código de los niños y adolescentes (ley n°27337) del año 2000 y diversos mecanismos jurídicos internacionales.
