EL INDULTO BAJO EL PRISMA CRIMINOLÓGICO. CLEMENCY ANALISYS.

Este trabajo es un análisis actual del indulto desde el enfoque innovador que aporta la criminología cuyo propósito es explicar en qué consiste, su uso dentro del sistema penal y su utilidad como herramienta de política penitenciaria y criminal. Se señalan las disfunciones que se encuentran y se proponen alternativas. Finalmente, se lanza una predicción sobre la continuidad de esta figura, muy controvertida por su colisión con la división de poderes. This paper is a current overview of clemency, made from the innovative approach of the criminology, aims to understand what it is, its use within the penal system and its usefulness as a tool in penitentiary and criminal policies. Then the dysfunctions are identified and alternatives are proposed. Finally, a prediction is made about the continuity of such program, which is controversial due to the conflict with the separation of powers.
