El ámbito de aplicación del actual art. 510 CP en retrospectiva y en prospectiva tras la reforma penal de 2015

Resumen: El legislador español, en la reciente reforma penal del año 2015, ha decidido reconfigurar por completo la regulación de los delitos relacionados con manifestaciones de odio, hostilidad, discriminación y violencia hacia determinados grupos u individuos por razón de su pertenencia a los mismos. Dicha nueva regulación plantea incógnitas interpretativas sobre a qué supuestos de hecho se va a poder aplicar el nuevo art. 510 CP pues, si bien la presencia de los anteriores arts. 510 y 607.2 CP en la jurisprudencia no había sido especialmente notable, tanto nuestros órganos jurisdiccionales como la doctrina científica habían hecho grandes esfuerzos interpretativos para restringir su ámbito de aplicación. Ahora, por tanto, cabe plantearse qué supuestos que antes no entraban en dicho ámbito de aplicación ahora sí estarían abarcados por el del nuevo art. 510 CP, y cuáles de los que empiezan a causar alarma social no deberían encontrar castigo a través del Derecho penal, si es que queremos preservar los contornos de la libertad de expresión.Palabras Clave: Discurso del Odio, Negacionismo, Libertad de Expresión, Ciberodio.Abstract: Spanish legislative power, at lastest Criminal Law reform on 2015, has decided to completely reconfigure the regulation of offences related to statements with hatred, hostility, discrimination and violence against certain groups or persons by reason of their belonging to them. The new regulation raises interpretative questions about to which cases will be the new art. 510 Penal Code applied, because, even though the presence of the former arts. 510 and 607.2 Penal Code in jurisprudence was not especially remarkable, both our courts and the authors had made great interpretive efforts to restrict their scope. Now, therefore, we have to consider which cases that before not entering on that scope, now could be covered by the new one, and what of those who begin to cause public alarm should not find punishment through the Criminal Law, if we want to preserve the outlines of the free speech.Keywords: Hate Speech, Negacionism, Free Speech, Cyberhate.
