Desnaturalización de categorías: independencia judicial y acceso a la justicia. Los avatares del proceso de Democratización de la Justicia en Argentina

Este artículo procura discutir algunas cuestiones vinculadas con el denominado proceso de Democratización de la Justicia en Argentina, el cual intentó llevarse a cabo en el transcurso de 2013. Los problemas aquí analizados se articulan estrechamente con el funcionamiento consuetudinario de los tribunales. A riesgo de cosificar conceptos y categorías, convirtiendo debates fluidos en axiomas por ser cumplidos, este trabajo pretende reflexionar sobre dos grandes ejes: i) el problema de la " independencia judicial " y el modo en que se entiende y se construye el mismo, y cómo interviene en este juego la categoría " familia judicial " , y ii) la discusión acerca del " acceso a la justicia ". Por último, y a modo de conclusión, se busca discurrir acerca de las posibilidades y los desafíos de pensar las reformas judiciales a partir de la discusión con actores extramuros. This article will attempt to discuss questions linked to the so-called ‘Democratization of the Justice System’ in Argentina, which was due to take place in 2013. The problems discussed here are closely linked to the traditional operations of the courts. At the risk of objectifying concepts and categories, converting clear debates into axioms to be fulfilled, this work will reflect on two main themes: i) the problem of ‘judicial independence’ and the way in which this is understood andachieved, and how the ‘judicial family’ fits into the equation, and ii) the discussion on ‘access to justice’. Finally, by way of conclusion, an attempt will be made to discuss the possibilities and challenges associated with considering judicial reforms through discussions with outside parties.
