Democracia representativa, conflito e justiça em J. S. Mill

This article seeks to analyze the relationship between representative democracy, conflict and justice in J. S. Mill's philosophy. Hence, we shall first reconstruct the concept of representative democracy presented in "Considerations on Representative Government." According to Mill, representative democracy must do its best to preserve political conflict. The division of political power among different social groups precludes the unbounded influence of only one group and thus promotes justice – that is, the respect of all individuals' moral rights. As we shall see, such a conception of power entails a dialogical relationship between representatives and their constituents. If a representative government is to be democratic, political power should not be confined to juridical or state institutions. For Mill, the communication between the public debates that unfold inside and outside governmental institutions is the foundation of political power in a representative democracy.RESUMO: Este artigo busca pensar a relação entre democracia representativa, conflito e justiça na filosofia de J. S. Mill. Para tanto, iremos, primeiro, reconstruir o conceito de democracia representativa apresentado em "Considerations on Representative Government". Segundo Mill, a democracia representativa deve esmerar-se para jamais esgotar o conflito político. A divisão do poder político entre diferentes grupos sociais impede a prevalência irrestrita de apenas um único grupo e promove, por conseguinte, a justiça – isto é, o respeito dos direitos morais de todos os indivíduos. Tal concepção de poder, veremos, envolve uma relação dialógica entre representante e representado. Para que um governo representativo seja de fato democrático, o poder político não pode restringir-se às instituições jurídico-estatais. Para Mill, a comunicação entre o debate público que ocorre dentro e fora das instituições governamentais é o fundamento do poder político em uma democracia representativa.
