A TUTELA PROVISÓRIA NO NOVO CÓDIGO DE PROCESSO CIVIL: COMPATIBILIDADE COM A JUSTIÇA DO TRABALHO? THE PROVISIONAL TUTELAGE IN THE NEW CIVIL PROCEDURE CODE: COMPATIBILITY WITH THE LABOR COURT

The present essay aims to discuss the compatibility of the Provisional Tutelage from the New Civil Procedure Code with the Labor Procedure, against the sensitive doctrinal development about the theme. As a research methodology, several scientific papers were held, from several scholars for the application of the New Code to the labor procedure, also with the aid of the interpretative statements from the Forum Permanente de Processualistas Civis (Permanent Forum of Civil Procedural Experts). Further up, it is established a parallel between the news of the Book V of the NCPC from the viewpoint of the article 769 of the CLT. In the midst of these discussions, is sought the most appropriate response to the thematic question in the light of the social principles of the Labor Court.
